Cardholder Agreement

Important–Pease Read Carefully

Vivabox Card

Please read this Cardholder Agreement (this "Agreement") carefully and save it for future reference. This Agreement constitutes the agreement outlining the terms and conditions under which the VivaBox card (the "Card") has been issued to you. In this Agreement, "You" and "Your" means the person or persons who have received the Card and are authorized to use the Card as provided for in this Agreement (also known as a "Cardholder"). "We", "Us" and "Our" refer to Vivaboxes US, Inc., our successors and assignees. By accepting and using, or authorizing any other person to use, your Card, you hereby agree to be bound by the terms and conditions contained in this Agreement and are responsible for all transactions involving the Card.

The Card is redeemable as described below. The Card is NOT a credit card, charge card or debit card.

Fees. There are no activation fees, monthly maintenance fees, or dormancy fees associated with the Card and the Card never expires.

Using Your Card. Your Card may be redeemed for certain goods or services available at Our website, www.vivaboxusa.com, or by calling 1-877-7000-BOX. The Card may be used only once and You may be required to tender the Card at the time of use. The Card may not be refunded or exchanged for cash or credit. We reserve the right to substitute certain goods or services with other goods or services of a similar nature and value. In addition, We may change the manufacturer or provider of goods or services as and when We deem necessary. Finally, We reserve the right to reimburse Cardholders a pre-determined cash amount if for any reason We are unable to redeem the Card for the goods or services originally identified. Please note Cards cannot be replaced and should be treated like cash.

Customer Service. You may find information related to the redemption of your Card at www.vivaboxusa.com, or call us at 1-877-7000-BOX. We do not warrant that the customer service channels will always be available and error free. We are not responsible for temporary interruptions in service due to maintenance, website changes or failures. We will not bear liability for any damage or interruptions caused by computer viruses that may affect your computer or other equipment. Disclosure of Information to Third Parties. We may disclose information to third parties about your Card redemption activities:

  • Where it is necessary for completing transactions;
  • In order to comply with government agency or court orders, or other legal reporting requirements;
  • To protect against potential fraud and other crimes
  • If you give us your written permission; or
  • When otherwise permitted by law.

Other information you have given us in connection with your transaction history may also be shared within our organization. Amendment, Cancellation or Revocation. We may amend or change the terms of this Agreement at any time and from time to time. We will post the changes on our web site at the address provided above under the section entitled "Customer Service." You will be deemed to have proper notice thirty (30) days after the changes are posted. We encourage you to review the web site regularly to monitor changes in the terms of this Agreement. Please note that if a change is made for security or regulatory reasons, we can implement it without your prior notice.

Governing Law. This agreement shall be governed by, and construed in accordance with the laws of the State of Florida.

Other Terms. In the event that any provision of this Agreement is determined to be invalid, illegal or unenforceable, such determination shall not affect the other provisions of this Agreement. Your obligations under this Agreement may not be assigned. We may transfer our rights under this Agreement. We do not waive our rights by any delay or failure to exercise them at any time.

The names, trademarks, logos and other indicia of participating merchants are used with permission.

Wine: Your privileges as a customer vary by state. My Wines Direct cannot legally ship wine to certain states. Please see www.vivaboxusa.com for a list of eligible shipping states. All orders are shipped by appropriately licensed permit holders in accordance with local law. By redeeming your certificate, you authorize My Wines Direct to act on your behalf to engage a common carrier to deliver your order to your selected destination where legally permitted. You must be 21 years or older to redeem an order for wine with My Wines Direct via Vivabox, Inc. By placing your order with Vivabox, Inc. via Vivabox, Inc.'s internet site (www.vivaboxusa.com) you certify under penalty of perjury that you and the recipient are at least 21 years old. When the wine is delivered, the recipient will be required to show photo identification proving that he or she is at least 21 years old. Program open to US residents only.

Gourmet: It is our goal to provide the freshest meal possible. Meals may change according to seasonal availability. Please check out website at www.vivaboxusa.com for the most updated menu.

Magazine (Men's, Women's):  REFUNDS:  Each magazine subscription has a value of $20.00 and refunds given will be based upon the remaining issues in your order as a ratio of this amount to full number of issues stated for each magazine.  To request a refund or reach customer serivce, please email cs@vivaboxusa.com, or call 1-877-7000-BOX (269) (M-F 9-5pm EST).  Limit one per household.  Please allow 4 - 8 weeks for delivery of first issue.  US Delivery Only.

Magazine Subscription:  REFUNDS:  Each magazine subscription has a value of $24.95 and refunds given will be based upon the remaining issues in your order as a ration of this amount to full number of issues stated for each magazine.  To request a refund or reach customer serivce, please email cs@vivaboxusa.com, or call 1-877-7000-BOX (269) (M-F 9-5pm EST).  Limit one per household.  Please allow 4 - 8 weeks for delivery of first issue.  US Delivery Only.

Movie Experience:  The magazine subscription of Entertainment Weekly has a value of $20.00.  To reach customer serivce, please email cs@vivaboxusa.com, or call 1-877-7000-BOX (269) (M-F 9-5pm EST).  If you prefer not to receive the magazine and would like a full rebate instead you may request it by completing the order card enclosed inside your gift or contacting customer service.  To print a copy of the order card, click here.  When completed please mail to:  9801 Washintgonian Blvd. Suite 546 Gaithersburg, MD 20878.  Limit one rebate per household.  Please allow 4 - 8 weeks for delivery of first issue.  US Delivery Only.
